General (all other countries) | Silicon: containing by weight not less than 99.99 percent of silicon (polysilicon itself: MIP only, no 15% ad valorem)
may-be-required only · ACE valid to 2039-12-31
no entered value: rates and limits only
Period 2026-10-01 – 2027-09-30 · 91 FR 48398 (2026-07-31, Doc. 2026-15530, FY2027)
Triggered through the supply chain (regardless of origin): check upstream for Xinjiang inputs or Entity List companies | Statutory high-priority sector. Hoshine is listed under section (i), so Hoshine silicon at any tier triggers the presumption. Trace quartz → metallurgical silicon → polysilicon → ingot → wafer → cell → module.
File a positive TSCA certification (complies with all TSCA rules / orders) or a negative certification (pesticides / food / drugs / cosmetics / nuclear material) in ACE when importing chemical substances or mixtures. The EP7 flag is advisory only and the certification is the importer's responsibility. Finished articles are generally exempt unless a specific rule applies. PFAS: one-time reporting of PFAS and PFAS-containing articles imported since 2011.
2025–26: The PFAS reporting window is postponed to 2027-01-31 or 60 days after the final rule (2026-04-13); the 2025-11 proposal to exempt imported articles and ≤0.1% content is not final
Schedule 1: import only from States Parties, 45-day advance notice to BIS, annual report. Schedule 2: import from non-States Parties prohibited, annual report above thresholds. Schedule 3: annual report.
From 2026-09-22 to 12-03 Commerce, with CBP, monitors polysilicon and derivative imports by importer of record (aggregate and weekly average since 2026-08-06 vs the 2026-01-01 to 08-06 and 2025 weekly averages, and use of affiliates that do not customarily import or of new IORs). An IOR found stockpiling, once notified by CBP, may not enter such goods for consumption before 2026-12-04 (bonded warehouse allowed); IORs registered on or after 2026-08-06 are limited per week to 12 kg of 2804.61.00, 7 kg of 3818.00.0020/.0040/.0045/.0050/.0091, 2,000 units of 8541.42.00 and 55 units of 8541.43.00. 2025–26: Effective 2026-09-22 (temporary final rule, through 2026-12-03); the 232 tariff and minimum import prices (MIP) take effect 2026-12-04
Before arrival: Confirm the substance is on the TSCA Inventory / complies with §5 / §6 orders; identify negative-certification categories (pesticides, food, drugs, cosmetics, nuclear material)
At entry: TSCA positive / negative certification in the PGA message set (or paper / DIS), with the certifier's name, e-mail and phone
Disclaim: EP7: A, B (§13 only, not Title VI); EP8 cannot be disclaimed
If missing: Refused admission; TSCA penalties
